If you want to challenge a decision made by the Home Office because you think they made the wrong decision – for example, they did not believe your asylum claim or your evidence in your family life application or they said you do not meet certain criteria – it may be that you are wanting to appeal that decision. ![]() It is not really about whether the decision was “right”, but whether the law has been correctly applied and the right procedures have been followed.Ī judicial review is different from an appeal. It could also be a decision made by a court.Ī judicial review can challenge the way a decision has been made, if you believe it was illegal, irrational or unfair. That will usually be a decision made by the Home Office.
